Exceptions to the Right of Cancellation
There are statutory exceptions to the Right of Cancellation (§ 312 para 4 BGB (German Civil Code)), whereby we reserve the right to invoke  the following rules in our contract with you: there is no Right of Cancellation in the case of distance contracts to supply goods that are produced to customer specifications or clearly tailored to personalized requirements nor for the delivery of audio or video recordings or software if the delivered data carriers have been unsealed by the consumer. The same applies to goods that are not suitable for return due to their properties and condition.

Thus there is no Right of Cancellation for your orders to download audio files, eBooks and / or software, as digital data that were not transferred to you on a disk but simply downloaded  are, by their nature, not suitable for returning (312, Section 4 No. 1 BGB German Civil Code)).


If you conclude the legal transaction as a consumer (within the meaning of § 13 BGB), i.e. for a purpose that can be attributed neither to your commercial nor your independent professional activity, you are entitled to a 14-day Right of Cancellation under the following provisions:

Right of Cancellation

You can cancel your contract declaration within 14 days without giving any reasons in text form (e.g. letter, fax, e-mail) or - if the goods are delivered before the deadline - by returning the goods. The time limit begins after receipt of this notice in written form, but not before receipt of the goods by the consignee (in case of recurring deliveries of similar goods not before receipt of the first partial delivery) and not before the fulfilment of  our obligations to provide information under Article 246 § 2 in conjunction with § 1 para . 1 and 2 EG BGB (Introductory Law to the German Civil Code), as well as our obligations in accordance with § 312e Section 1 Clause 1 BGB in conjunction with Article 246 § 3 EGBGB (Introductory Law to the German Civil Code). For the observance of the Right of Cancellation period it suffices to send the cancellation or return the goods. The cancellation must be sent to:

Consequences of Cancellation

In the event of an effective cancellation, services received by both parties must be reimbursed and if applicable, any benefits derived (e.g. interest) surrendered. If you are not able to return to us benefits received as a whole or in part, or only in a deteriorated condition, you must pay us compensation for lost  value to that extent if required. For the surrendering of goods, this does not apply if the deterioration of the goods is exclusively due to their inspection (as might  possibly have been the case in a retail store.) In addition, you can avoid the obligation to pay compensation if the deterioration of the goods was caused by the proper and designated putting into use of the goods, by not  using the goods as if they were your own property and desisting from doing anything that could reduce their value. Items that can be sent by parcel are to be returned at our expense and risk. Items that cannot be sent by parcel will be collected from you. Obligations to reimburse payments must be made within 30 days. The time period begins for you when you send your cancellation or the goods, for us upon their receipt.

Right of Cancellation from Sample Purchases

You can cancel your contract within 14 days without giving any reasons in text form (e.g. letter, fax, e-mail) or - if the goods are delivered before the deadline - by returning the goods. The time limit begins after receipt of this notice in written form, but not before receipt of the goods by the consignee (in case of recurring deliveries of similar goods not before receipt of the first partial delivery) and not before the fulfilment of  our obligations to provide information under Article 246 § 2 in conjunction with § 1 para . 1 and 2 EG BGB (Introductory Law to the German Civil Code), as well as our obligations in accordance with § 312e Section 1 Clause 1 BGB in conjunction with Article 246 § 3 EGBGB (Introductory Law to the German Civil Code) and also not before the purchase contract has become binding on you by your acceptance of the purchased item. For ensuring the Right of Cancellation period it suffices to send the cancellation or return the goods.
